1 An Act relating to the inspection obligations of the department
2 of inspections, appeals, and licensing associated with hotel
3 sanitation.

1 Section 1. Section 137C.12, Code 2024, is amended to read
2 as follows:
3 137C.12 Inspection upon complaint.
4 Upon receipt of a verified complaint signed by a guest
5 of a hotel and stating facts indicating the place is in an
6 insanitary condition, the regulatory authority shall conduct
7 an inspection. The inspector may enter the hotel at any
8 reasonable hour to make the inspection. The management shall
9 afford free access to every part of the premises and render all
10 aid and assistance necessary to enable the inspector to make a
11 thorough and complete inspection.
12 Sec. 2. REPEAL. Section 137C.11, Code 2024, is repealed.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill repeals the requirement that the department of
17 inspections, appeals, and licensing (DIAL) or a local board of
18 health conduct biennial sanitation inspections of all hotels
19 in Iowa. The bill moves certain provisions associated with
20 inspections from the repealed provision to the provision
21 requiring DIAL to inspect a hotel upon receiving a complaint.
