1 An Act relating to the use of moneys appropriated to support
2 therapeutic classrooms, and including effective date
3 provisions.

1 Section 1. 2023 Iowa Acts, chapter 111, section 2,
2 subsection 27, is amended to read as follows:
3 27. THERAPEUTIC CLASSROOM TRANSPORTATION CLAIMS
4 REIMBURSEMENT
5 For payment of school district claims for reimbursement
6 submitted under section 256.25A, subsection 1, paragraph “a”:
7 .................................................. $ 500,000
8 Notwithstanding section 8.33, moneys appropriated pursuant
9 to this subsection that remain unencumbered or unobligated at
10 the close of the fiscal year shall not revert but shall remain
11 available for expenditure for the purposes designated until the
12 close of the succeeding fiscal year. Any moneys appropriated
13 pursuant to this subsection that remain unencumbered or
14 unobligated after the completion of payments under section
15 256.25A, subsection 1, paragraph “a”, may be deposited in the
16 therapeutic classroom incentive fund created in section 256.25,
17 as determined by the department.
18 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
19 importance, takes effect upon enactment.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 For FY 2023-2024, the general assembly appropriated $500,000
24 to the department of education for payment of school district
25 claims for transportation reimbursement submitted in connection
26 with therapeutic classroom services. This bill authorizes the
27 deposit of moneys that remain unencumbered or unobligated after
28 the completion of such payments into the therapeutic classroom
29 incentive fund created in Code section 256.25, as determined
30 by the department. That fund is used to distribute grants to
31 school districts under the therapeutic classroom incentive
32 grant program.
