A BILL FOR
1 An Act relating to the department of administrative services’
2 process for managing the physical resources of state
3 government, including the selection of state employees’
4 office space.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 8A.321, subsection 6, paragraph c,
2 subparagraph (1), Code 2024, is amended to read as follows:
3 (1) Prior to replacing or renovating publicly owned
4 buildings or relocating any state agencies at the seat of
5 government to any space in publicly owned buildings, the
6 department shall may issue a request for proposals for leasing
7 privately owned office space for state employees in the
8 downtown area of the city of Des Moines and shall may use
9 such proposals to compare the costs of privately owned space
10 to publicly owned space. The department shall locate state
11 employees in office space in the most cost-efficient manner
12 possible. In determining cost efficiency, the department shall
13 consider all costs of the publicly owned space, the costs of
14 the original acquisition of the publicly owned space, the costs
15 of tenant improvements to the publicly owned space, and the
16 anticipated economic and useful life of the publicly owned
17 building space. For purposes of this subparagraph, “publicly
18 owned building” does not include existing space within buildings
19 located at the capitol complex or otherwise owned by the state.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 Current law requires that, prior to replacing or renovating
24 publicly owned buildings or relocating any state agencies in
25 Des Moines within publicly owned buildings, the director of
26 the department of administrative services issue a request for
27 proposals for leasing privately owned office space and use
28 such proposals to compare costs of the public and private
29 spaces. This bill excludes existing space within capitol
30 complex buildings and buildings owned by the state from the
31 term “publicly owned building” for purposes of this process.
32 The bill also makes the decision to issue or use a request for
33 proposals discretionary.
34 The bill does not amend the provisions under current law
35 providing for an exemption to this process in emergency

1 circumstances and excluding the department of public defense
2 and the armory board from this process.
