2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 808.4, Code 2024, is amended to read as
2 follows:
3 808.4 Issuance.
4 Upon a finding of probable cause for grounds to issue a
5 search warrant, the magistrate shall issue a warrant, signed by
6 the magistrate with the magistrate’s name of office, directed
7 to any peace officer, commanding that peace officer forthwith
8 to search the named person, place, or thing within the state
9 for the property specified, and to bring a list of any property
10 seized before the magistrate.
11 EXPLANATION
12 The inclusion of this explanation does not constitute agreement with
13 the explanation’s substance by the members of the general assembly.
14 This bill relates to the issuance of a search warrant.
15 The bill provides that after a peace officer has executed
16 a search warrant issued by a magistrate commanding the peace
17 officer to search the named person, place, or thing within the
18 state for the property specified, the peace officer shall bring
19 a list of any property seized before the magistrate.
20 Current law requires the peace officer to bring the seized
21 property before the magistrate.
