1 An Act relating to autologous and directed blood donations.
2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 135.39F Autologous or directed
2 blood donations.
3 1. A blood bank that facilitates autologous or directed
4 blood donations shall comply with a physician’s order for an
5 autologous or directed blood donation.
6 2. A blood bank may charge a fee in an amount reasonable
7 and necessary to cover the administrative costs to the blood
8 bank of facilitating an autologous or directed blood donation
9 ordered by a physician under subsection 1.
10 3. For the purposes of this section:
11 a. “Autologous blood donation” means a blood donation made
12 by an individual for the individual’s own use.
13 b. “Blood bank” means the same as defined in section 141A.1.
14 c. “Directed blood donation” means the donation of blood
15 or blood components for the purpose of transfusion into a
16 specified individual.
17 Sec. 2. NEW SECTION. 135B.36 Autologous or directed blood
18 donation.
19 1. If a hospital licensed under this chapter facilitates
20 blood donations, the hospital shall allow an individual on whom
21 a medical procedure is to be performed to provide an autologous
22 or directed blood donation ordered by a physician for the
23 medical procedure.
24 2. For the purposes of this section, “autologous blood
25 donation” and “directed blood donation” mean the same as defined
26 in section 135.39F.
27 EXPLANATION
28 The inclusion of this explanation does not constitute agreement with
29 the explanation’s substance by the members of the general assembly.
30 This bill relates to autologous or directed blood donations.
31 The bill provides that a blood bank that facilitates autologous
32 or directed blood donations shall comply with a physician’s
33 order for an autologous or directed blood donation. A blood
34 bank may charge a fee in an amount reasonable and necessary
35 to cover the administrative costs to the blood bank of

1 facilitating an autologous or directed blood donation ordered
2 by a physician. The bill also provides that if a licensed
3 hospital facilitates blood donations, the hospital shall allow
4 an individual on whom a medical procedure is to be performed to
5 provide an autologous or directed blood donation ordered by a
6 physician for the medical procedure.
7 The bill defines “autologous blood donation”, “blood bank”,
8 and “directed blood donation” for the purposes of the bill.
