A BILL FOR
1 An Act relating to the eligibility of students enrolled
2 in public schools or nonpublic schools to compete in
3 extracurricular interscholastic athletic contests or
4 competitions provided by other public schools or nonpublic
5 schools.
6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 280.13D Participation in
2 extracurricular interscholastic athletic contests or competitions
3 provided by public schools or nonpublic schools.
4 1. The board of directors of a school district shall allow
5 a student who resides within the school district and who is
6 enrolled in a nonpublic school to participate immediately
7 in any extracurricular interscholastic athletic contest or
8 competition provided by the school district pursuant to the
9 terms of an agreement between the board of directors of the
10 school district and the authorities in charge of the nonpublic
11 school that provides for the eligibility of the student.
12 2. a. The authorities in charge of a nonpublic school
13 shall allow a student who resides within the school district
14 where the nonpublic school is located and who is enrolled
15 in such school district to participate immediately in any
16 extracurricular interscholastic athletic contest or competition
17 provided by the nonpublic school pursuant to the terms of an
18 agreement between the authorities in charge of the nonpublic
19 school and the board of directors of the school district that
20 provides for the eligibility of the student.
21 b. The authorities in charge of a nonpublic school may
22 establish a reasonable fee for the cost of a student’s
23 participation in an extracurricular interscholastic athletic
24 contest or competition pursuant to paragraph “a”. The student,
25 or the student’s parent or guardian, shall be responsible for
26 the payment of such fee.
27 3. An organization, as defined in section 280.13, shall not
28 take into account the number of students who participate in an
29 extracurricular interscholastic athletic contest or competition
30 provided by a school district or a nonpublic school pursuant to
31 this section when determining the classification of a public
32 school or a nonpublic school.
33 4. A student who participates in an extracurricular
34 interscholastic athletic contest or competition pursuant
35 to this section shall be deemed to satisfy the residence

1 requirements for purposes of section 256.46.
2 EXPLANATION
3 The inclusion of this explanation does not constitute agreement with
4 the explanation’s substance by the members of the general assembly.
5 This bill relates to the eligibility of students
6 enrolled in public schools or nonpublic schools to compete
7 in extracurricular interscholastic athletic contests or
8 competitions provided by other public schools or nonpublic
9 schools.
10 The bill requires school districts to allow a student
11 who resides within the school district and who is enrolled
12 in a nonpublic school to participate immediately in any
13 extracurricular interscholastic athletic contest or competition
14 provided by the school district pursuant to the terms of an
15 agreement between the school district and the nonpublic school
16 that provides for the eligibility of the student.
17 The bill also requires nonpublic schools to allow a
18 student who resides within the school district where the
19 nonpublic school is located and who is enrolled in such school
20 district to participate immediately in any extracurricular
21 interscholastic athletic contest or competition provided by the
22 nonpublic school pursuant to the terms of an agreement between
23 the nonpublic school and the school district that provides for
24 the eligibility of the student. The bill authorizes nonpublic
25 schools to establish a reasonable fee for the cost of a
26 student’s participation in such extracurricular interscholastic
27 athletic contest or competition. The bill provides that the
28 student, or the student’s parent or guardian, is responsible
29 for the payment of the fee.
30 The bill establishes that a student who participates in an
31 extracurricular interscholastic athletic contest or competition
32 pursuant to these provisions shall be deemed to satisfy
33 the residence requirements of Code section 256.46 (rules
34 for participation in extracurricular activities by certain
35 children).

1 The bill prohibits an organization, as defined in Code
2 section 280.13 (requirements for interscholastic athletic
3 contests and competitions), from taking into account the
4 number of students who participate in an extracurricular
5 interscholastic athletic contest or competition pursuant to
6 these provisions when determining the classification of a
7 public school or a nonpublic school.
