1 Section 1. MEDICAID —— REIMBURSEMENT FOR THE REPAIR OF
2 COMPLEX REHABILITATION TECHNOLOGY. Under both Medicaid
3 managed care and fee-for-service administration of the
4 Medicaid program, the department of health and human services
5 shall not require a prescription or prior authorization
6 for reimbursement of a provider for the repair of complex
7 rehabilitation equipment, if the complex rehabilitation
8 technology was previously prescribed and reimbursed under
9 the Medicaid program. For the purposes of this section,
10 “complex rehabilitation technology” means items classified
11 under the Medicare program as durable medical equipment that
12 is individually configured for individuals to meet their
13 specific and unique medical, physical, and functional needs
14 and capacities for basic activities of daily living and
15 instrumental activities of daily living identified as medically
16 necessary.
17 EXPLANATION
18 The inclusion of this explanation does not constitute agreement with
19 the explanation’s substance by the members of the general assembly.
20 This bill provides that under both Medicaid managed care
21 and fee-for-service administration of the Medicaid program,
22 the department of health and human services shall not
23 require provision of a prescription or prior authorization
24 for reimbursement of a provider for the repair of complex
25 rehabilitation equipment, if the complex rehabilitation
26 technology was previously prescribed and reimbursed under the
27 Medicaid program. The bill defines “complex rehabilitation
28 technology” for the purposes of the bill.
