1 An Act relating to personal information of the previous owner
2 of a motor vehicle.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 321.24, subsections 3 and 9, Code 2024,
2 are amended to read as follows:
3 3. The certificate of title shall must contain upon its
4 face the identical information required upon the face of the
5 registration receipt. In addition, the certificate of title
6 shall must contain a statement of the owner’s title, the
7 title number assigned to the owner or owners of the vehicle,
8 the name and address of the previous owner, and a statement
9 of all security interests and encumbrances as shown in the
10 application, upon the vehicle described, including the nature
11 of the security interest, date of perfection, and name and
12 mailing address of the secured party.
13 9. The county treasurer or the department shall maintain
14 in the county or department records system the information
15 contained on the certificate of title and the name and
16 address of the previous owner. The information shall must be
17 accessible by title certificate number for a period of three
18 years from the date of notification of cancellation of title
19 or date that a new title has been issued as provided in this
20 chapter. Copies the department requires shall be sent to
21 the department in the manner and at the time the department
22 directs. The department shall designate a uniform system of
23 title numbers to indicate the county of issuance.
24 Sec. 2. Section 321.31, subsection 1, paragraph a, Code
25 2024, is amended to read as follows:
26 a. The department shall install and maintain a records
27 system which shall must contain the name and address of the
28 vehicle owner, current and previous registration number,
29 vehicle identification number, make, model, style, date of
30 purchase, registration certificate number, maximum gross
31 weight, weight, list price or value of the vehicle as fixed
32 by the department, fees paid, and date of payment, and the
33 name and address of the previous owner. The records system
34 shall must also contain a record of the certificate of title
35 including such information as the department deems necessary.

1 The information to be kept in the records system shall be
2 entered within forty-eight hours after receipt insofar as is
3 practical. The records system shall constitute the permanent
4 record of ownership of each vehicle titled under the laws of
5 this state.
6 Sec. 3. Section 321.31, subsection 2, paragraph a, Code
7 2024, is amended to read as follows:
8 a. Each county treasurer’s office shall maintain a county
9 records system for vehicle registration and certificate of
10 title documents. The records system shall must consist of
11 information from the certificate of title, including the
12 date of perfection and cancellation of security interests,
13 and information from the registration receipt, and the name
14 and address of the previous owner. The information shall be
15 maintained in a manner approved by the department.
16 EXPLANATION
17 The inclusion of this explanation does not constitute agreement with
18 the explanation’s substance by the members of the general assembly.
19 This bill strikes the requirement for a certificate of
20 title issued for a vehicle to contain the name and address
21 of the previous owner, and instead requires the department
22 of transportation (DOT) or county treasurer to maintain the
23 previous owner’s information in the DOT’s or county treasurer’s
24 records systems along with the other certificate of title
25 information.
