A BILL FOR
1 An Act requiring proof of citizenship or lawful presence in the
2 country for a student to be classified for in-state tuition
3 and fees at a regents institution or community college.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 260C.14, subsection 14, Code 2024, is
2 amended by adding the following new paragraph:
3 NEW PARAGRAPH. c. Adopt rules to prohibit the community
4 college from classifying a student as a resident of this state
5 for purposes of tuition and fees unless the student provides
6 proof of United States citizenship or proof that the individual
7 is lawfully present in the United States.
8 Sec. 2. Section 262.9, subsection 17, Code 2024, is amended
9 by adding the following new paragraph:
10 NEW PARAGRAPH. c. Adopt rules to prohibit institutions of
11 higher education under its control from classifying a student
12 as a resident of this state for purposes of tuition and fees
13 unless the student provides proof of United States citizenship
14 or proof that the individual is lawfully present in the United
15 States.
16 EXPLANATION
17 The inclusion of this explanation does not constitute agreement with
18 the explanation’s substance by the members of the general assembly.
19 This bill requires the board of regents and the board of
20 directors of a community college to adopt rules to prohibit a
21 regents institution or community college from classifying a
22 student as a resident of this state for purposes of tuition
23 and fees unless the student provides proof of United States
24 citizenship or proof that the individual is lawfully present in
25 the United States.
