3 enforcement to access registration, titling, and driver’s
4 license information.

1 Section 1. NEW SECTION. 321.491A Driver improvement
2 information.
3 The department shall include in the electronic database used
4 by the department and law enforcement to access registration,
5 titling, and driver’s license information, details indicating
6 whether a driver has been required by the department or ordered
7 by a court to complete remedial driver improvement action,
8 including any driver improvement education course, following an
9 arrest, citation, conviction, or accident, and if so, whether
10 the driver completed the action.
11 EXPLANATION
12 The inclusion of this explanation does not constitute agreement with
13 the explanation’s substance by the members of the general assembly.
14 This bill requires the department of transportation (DOT)
15 to include in the electronic database used by the DOT and law
16 enforcement to access registration, titling, and driver’s
17 license information, details indicating whether a driver
18 has been required to take or has completed remedial driver
19 improvement action, including a driver improvement education
20 course.
21 Under current law and administrative rules adopted by the
22 DOT, the DOT must require remedial driver improvement action
23 when a person holding an instruction permit, intermediate
24 license, or full-privilege driver’s license under Code
25 section 321.180B is convicted of a moving violation or has a
26 contributive accident, and the violation or accident occurred
27 during the term of the instruction permit or intermediate
28 license. In addition, the DOT may require a driver to complete
29 a driver improvement program in lieu of driver’s license
30 suspension under certain circumstances.
