3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 49.21, subsection 2, Code 2024, is
2 amended by adding the following new paragraph:
3 NEW PARAGRAPH. c. The commissioner shall not select
4 a school as a polling place unless the commissioner first
5 determines that no other buildings or grounds supported
6 by taxation under the laws of this state or otherwise made
7 available for use as a polling place without charge satisfy the
8 requirements of this section.
9 Sec. 2. Section 49.24, Code 2024, is amended to read as
10 follows:
11 49.24 Schoolhouses as polling places.
12 In precincts outside of cities the election shall, if
13 practicable and consistent with section 49.21, be held in
14 a public school building. Any damage to the building or
15 furniture resulting from the election shall be paid by the
16 county.
17 EXPLANATION
18 The inclusion of this explanation does not constitute agreement with
19 the explanation’s substance by the members of the general assembly.
20 This bill prohibits a county commissioner of elections from
21 selecting a school as a polling place unless the commissioner
22 first determines that no other buildings or grounds supported
23 by taxation under the laws of this state or that would
24 otherwise be made available for use as a polling place without
25 charge would satisfy the requirements of Code section 49.21
26 (polling places —— accessibility —— signs).
