1 An Act relating to restrictions on the acquisition of real
2 property by the department of natural resources.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 461A.10A Restrictions on acquiring
2 real property.
3 1. The department shall not acquire real property available
4 for sale at an auction for real property. The department
5 shall only acquire real property from a willing donor or
6 willing seller, who shall not be under any compulsion by the
7 department. The department shall not acquire real property by
8 donation or purchase from a nonprofit corporation that acquired
9 the real property in a competitive manner, including but not
10 limited to at an auction.
11 2. For purposes of this section, “auction” means a public
12 auction or private auction, including but not limited to an
13 auction by electronic means, an auction by sealed bid, or a
14 conventional oral auction.
15 Sec. 2. Section 461A.11, subsection 1, Code 2024, is amended
16 to read as follows:
17 1. The commission may accept gifts of land or other
18 property, subject to section 461A.10, or the use of lands or
19 other property for a term of years, and improve and use the
20 land as public state parks.
21 EXPLANATION
22 The inclusion of this explanation does not constitute agreement with
23 the explanation’s substance by the members of the general assembly.
24 This bill restricts the acquisition of real property by the
25 department of natural resources (DNR). The bill authorizes DNR
26 to only acquire property through willing donors and sellers,
27 who shall not be under the compulsion of DNR. DNR also shall
28 not acquire property from a nonprofit that acquired property in
29 a competitive manner, including at an auction.
