1 Section 1. NEW SECTION. 709.8A Grooming.
2 1. A person commits grooming when the person knowingly uses
3 a computer, internet service, or any other electronic data
4 storage or transmission device, performs an act in person or by
5 conduct through a third party, or uses written communication
6 to seduce, solicit, lure, or entice, or attempt to seduce,
7 solicit, lure, or entice, a child, a child’s guardian, or
8 another person believed by the person to be a child or a
9 child’s guardian to commit any sex act or to otherwise engage
10 in any unlawful sexual conduct with a child or with another
11 person believed by the person to be a child. As used in this
12 section, “child” means a person under seventeen years of age.
13 2. Grooming is a class “D” felony.
14 EXPLANATION
15 The inclusion of this explanation does not constitute agreement with
16 the explanation’s substance by the members of the general assembly.
17 This bill establishes the criminal offense of grooming.
18 The bill provides that a person commits grooming when the
19 person knowingly uses a computer, internet service, or any
20 other electronic data storage or transmission device, performs
21 an act in person or by conduct through a third party, or uses
22 written communication to seduce, solicit, lure, or entice,
23 or attempt to seduce, solicit, lure, or entice, a child, a
24 child’s guardian, or another person believed by the person to
25 be a child or a child’s guardian to commit any sex act or to
26 otherwise engage in any unlawful sexual conduct with a child or
27 with another person believed by the person to be a child. The
28 bill defines “child” as a person under 17 years of age.
29 The bill provides that grooming is a class “D” felony. A
30 class “D” felony is punishable by confinement for no more than
31 five years and a fine of at least $1,025 but not more than
32 $10,245.
