1 Section 1. Section 331.901, subsection 5, Code 2024, is
2 amended to read as follows:
3 5. A county or township officer or employee shall not
4 appropriate, give, or loan public funds to or in favor of
5 an institution, school, association, or object which that is
6 under ecclesiastical or sectarian management or control unless
7 the public funds are to be utilized for a project or program
8 that benefits the public and does not require any religious
9 or secular services, educational programs, or participation
10 requirements.
11 EXPLANATION
12 The inclusion of this explanation does not constitute agreement with
13 the explanation’s substance by the members of the general assembly.
14 This bill relates to the use of county funds by
15 ecclesiastical and sectarian institutions. The bill allows
16 public funds to be utilized by an ecclesiastical or sectarian
17 institution for a project or program if it benefits the
18 public. The project or program using public funds must not
19 require religious or secular services, educational programs, or
20 participation requirements. Current law prohibits a county or
21 township officer from appropriating, giving, or loaning public
22 funds to institutions, schools, associations, or objects under
23 ecclesiastical or sectarian management or control.
