1 An Act providing an exception to a minor’s legal capacity to
2 consent to the provision of medical care or services for a
3 sexually transmitted disease or infection.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 139A.35, Code 2024, is amended to read
2 as follows:
3 139A.35 Minors.
4 A With the exception of the provision of a vaccination for
5 a sexually transmitted disease or infection, a minor shall
6 have the legal capacity to act and give consent to provision
7 of medical care or services to the minor for the prevention,
8 diagnosis, or treatment of a sexually transmitted disease or
9 infection by a hospital, clinic, or health care provider.
10 Such medical care or services shall be provided by or under
11 the supervision of a physician licensed to practice medicine
12 and surgery or osteopathic medicine and surgery, a physician
13 assistant, or an advanced registered nurse practitioner.
14 Consent shall not be subject to later disaffirmance by reason
15 of such minority. The consent of another person, including but
16 not limited to the consent of a spouse, parent, custodian, or
17 guardian, shall not be necessary.
18 EXPLANATION
19 The inclusion of this explanation does not constitute agreement with
20 the explanation’s substance by the members of the general assembly.
21 This bill relates to the legal capacity of a minor to consent
22 to provision of medical care or services to the minor for the
23 prevention, diagnosis, or treatment of a sexually transmitted
24 disease or infection. Under Code section 139A.35, a minor
25 has the legal capacity to act and give consent to provision
26 of medical care or services to the minor for the prevention,
27 diagnosis, or treatment of a sexually transmitted disease or
28 infection by a hospital, clinic, or health care provider. The
29 bill amends the Code section to provide an exception to the
30 minor’s legal capacity to consent. Under the bill, a minor
31 does not have the legal capacity to consent to the provision of
32 vaccinations for a sexually transmitted disease or infection.
