1 Section 1. DEPARTMENT OF HEALTH AND HUMAN SERVICES ——
2 UNSUPERVISED CARE. The department of health and human services
3 is directed to amend its administrative rules pursuant to
4 chapter 17A to provide that employees and substitutes of a
5 child care center who are sixteen years of age or older may,
6 without additional supervision, provide child care to children
7 up to five years of age provided that at least two other
8 persons who are eighteen years of age or older and employed by
9 the child care center to provide child care are present in the
10 child care center. For the purposes of this section, “child
11 care” and “child care center” mean the same as defined in
12 section 237A.1.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill requires the department of health and human
17 services to amend its administrative rules to provide that
18 employees and substitutes of a child care center who are 16
19 years of age or older may, without additional supervision,
20 provide child care to children up to 5 years of age provided
21 that at least two other persons who are 18 years of age or older
22 and are employed by the child care center to provide child
23 care to children are present in the child care center. “Child
24 care” means the care, supervision, and guidance of a child by a
25 person other than the child’s parent, guardian, or custodian
26 for periods of less than 24 hours per day per child on a regular
27 basis, with certain exceptions. “Child care center” means a
28 facility providing child care or preschool services for seven
29 or more children, except when the facility is registered as a
30 child development home.
