1 An Act relating to requirements and prohibitions relating to
2 the reporting of vaccine and immunization administration.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 139A.8C Statewide immunization
2 registry and Iowa health information network —— informed consent.
3 The department shall require that a health care provider
4 who administers vaccines and immunizations and is required to
5 consult and review or report the administration of vaccines
6 or immunizations to the statewide immunization registry or
7 Iowa health information network obtain written, informed
8 consent from a patient, or if the patient is a minor, the
9 patient’s parent or legal guardian, prior to reporting the
10 administration of the vaccine or immunization to the statewide
11 immunization registry or Iowa health information network.
12 The written, informed consent shall also provide the patient
13 with the option of consenting to the sharing of the patient’s
14 information with any entity with access to the information
15 contained in the statewide immunization registry or Iowa
16 health information network. The health care provider shall
17 submit a copy of the completed written, informed consent
18 form to the statewide immunization registry or Iowa health
19 information network. A patient, or if the patient is a minor,
20 the patient’s parent or legal guardian, may withdraw or amend
21 the written, informed consent at any time. If informed consent
22 is subsequently withdrawn, the patient’s information shall be
23 deleted from the statewide immunization registry or Iowa health
24 information network database. Only the information regarding
25 the administration of vaccines or immunizations of a patient
26 from whom written, informed consent has been obtained shall be
27 reported to and included in the statewide immunization registry
28 or Iowa health information network. No information, report, or
29 record relating to a person from whom written, informed consent
30 has not been obtained shall be maintained by the department or
31 included in the statewide immunization registry or Iowa health
32 information network.

1 This bill relates to the reporting of vaccine and
2 immunization administration to the statewide immunization
3 registry and the Iowa health information network (IHIN). The
4 bill requires the department of health and human services to
5 require that a health care provider who administers vaccines
6 and immunizations and is required to consult and review or
7 report the administration of vaccines or immunizations to
8 the statewide immunization registry or IHIN obtain written,
9 informed consent from a patient, or if the patient is a minor,
10 the patient’s parent or legal guardian, prior to reporting the
11 administration of the vaccine or immunization to the statewide
12 immunization registry or IHIN. The written, informed consent
13 shall also provide the patient with the option of consenting
14 to the sharing of the patient’s information with any entity
15 with access to the information contained in the statewide
16 immunization registry or IHIN. The health care provider shall
17 submit a copy of the completed written, informed consent form
18 to the statewide immunization registry or IHIN. A patient,
19 or if the patient is a minor, the patient’s parent or legal
20 guardian, may withdraw or amend the informed consent at any
21 time. If informed consent is subsequently withdrawn, the
22 patient’s information shall be deleted from the statewide
23 immunization registry or IHIN. Additionally, only information
24 regarding the administration of vaccines or immunizations of a
25 patient from whom written, informed consent has been obtained
26 shall be reported to and included in the statewide immunization
27 registry or IHIN. No other information, report, or record
28 relating to a person from whom written, informed consent has
29 not been obtained shall be maintained by the department or
30 included in the statewide immunization registry or IHIN.
