1 An Act relating to the purchase of certain law enforcement

3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 12K.1 Noncompliant armament ——
2 purchase with public moneys prohibited.
3 1. As used in this section:
4 a. “Armament” means body armor or other protective equipment
5 used by a peace officer.
6 b. “Law enforcement agency” means a state-level or
7 county-level department, agency, or office that employs peace
8 officers.
9 c. “Peace officer” means the same as defined in section
10 801.4.
11 d. “Public moneys” means moneys deriving from tax revenues
12 that are appropriated to, granted to, or transferred to a law
13 enforcement agency. “Public moneys” does not include privately
14 funded grants, gifts, or donations.
15 2. A law enforcement agency shall not use public moneys to
16 purchase or otherwise acquire armament unless such armament
17 has been certified as compliant with the most recently adopted
18 standards of the national institute of justice.
19 EXPLANATION
20 The inclusion of this explanation does not constitute agreement with
21 the explanation’s substance by the members of the general assembly.
22 This bill prohibits a law enforcement agency from using
23 public moneys to purchase or otherwise acquire armament
24 unless such armament has been certified as compliant with the
25 most recently adopted standards of the national institute
26 of justice. The bill defines “armament”, “law enforcement
27 agency”, “peace officer”, and “public moneys” for purposes of
28 the bill.
