1 An Act relating to the transportation to and from school of
2 pupils participating in open enrollment.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 282.18, subsection 8, paragraph b, Code
2 2023, is amended to read as follows:
3 b. (1) A receiving district may send school vehicles more
4 than two miles into the district of residence of the pupil
5 using the open enrollment option under this section, for the
6 purpose of transporting the pupil to and from school in the
7 receiving district, if the boards of both the sending and
8 receiving districts agree to this arrangement.
9 (2) A receiving district may send school vehicles not more
10 than two miles into the district of residence of the pupil
11 using the open enrollment option under this section, for the
12 purpose of transporting the pupil to and from school in the
13 receiving district, without entering into an agreement with the
14 board of the sending district.
15 EXPLANATION
16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to the transportation to and from school
19 of pupils participating in open enrollment. Current law
20 authorizes a receiving school district to send school vehicles
21 into the district of residence of a pupil who open enrolls,
22 for the purpose of transporting the pupil to and from school
23 in the receiving school district, if the boards of directors
24 of the sending school district and receiving school district
25 agree to this arrangement. The bill strikes the requirement
26 that the boards of directors of the sending school district and
27 receiving school district agree to the arrangement in cases
28 where the receiving district’s school vehicles do not travel
29 more than two miles into the pupil’s district of residence.
