2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 335.36 Rock blasting —— setbacks.
2 A county shall require operations that involve rock blasting
3 to conduct such rock blasting no less than five hundred feet
4 from the property line. However, a county shall not enact a
5 setback requirement greater than five hundred feet for rock
6 blasting activities.
7 Sec. 2. NEW SECTION. 414.34 Rock blasting —— setbacks.
8 A city shall require operations that involve rock blasting
9 to conduct such rock blasting no less than five hundred feet
10 from the property line. However, a city shall not enact a
11 setback requirement greater than five hundred feet for rock
12 blasting activities.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill requires counties and cities to require operations
17 that involve rock blasting to conduct such rock blasting no
18 less than 500 feet from the property line. However, the
19 bill prohibits counties and cities from enacting a setback
20 requirement greater than 500 feet for rock blasting activities.
