SENATE JOINT RESOLUTION
1 A Joint Resolution proposing an amendment to the Constitution
2 of the State of Iowa recognizing a right of persons to food
3 and a fundamental right to be free from hunger.
4 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. The following amendment to the Constitution of
2 the State of Iowa is proposed:
3 Article I of the Constitution of the State of Iowa is amended
4 by adding the following new section:
5 Sec. 24A. Food security. All people have a natural,
6 inherent, and unalienable right to food, including the right
7 to acquire, produce, process, prepare, preserve, and consume
8 the food of their own choosing by hunting, gathering, foraging,
9 farming, fishing, gardening, and saving and exchanging seeds
10 or by barter, trade, or purchase from sources of their own
11 choosing, for their nourishment, sustenance, bodily health, and
12 well-being, as long as an individual does not commit trespass,
13 theft, poaching, or other abuses of private property rights,
14 public lands, or natural resources in the acquisition of food.
15 All people have a fundamental right to be free from hunger,
16 malnutrition, starvation, and the endangerment of life from the
17 scarcity of or lack of access to nourishing food.
18 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed
19 amendment to the Constitution of the State of Iowa is referred
20 to the general assembly to be chosen at the next general
21 election for members of the general assembly, and shall be
22 published as provided by law for three months previous to the
23 date of that election.
24 EXPLANATION
25 The inclusion of this explanation does not constitute agreement with
26 the explanation’s substance by the members of the general assembly.
27 This joint resolution proposes to amend the Constitution
28 of the State of Iowa by recognizing that all people have a
29 natural, inherent, and unalienable right to food and that all
30 people have a fundamental right to be free from hunger and a
31 lack of access to nourishing food. The resolution, if adopted,
32 would be published and then referred to the next general
33 assembly (91st) for adoption, before being submitted to the
34 electorate for ratification.
