1 An Act relating to physical examinations of personnel working
2 in licensed or registered child care facilities.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 237A.5, subsection 1, Code 2023, is
2 amended by striking the subsection.
3 EXPLANATION
4 The inclusion of this explanation does not constitute agreement with
5 the explanation’s substance by the members of the general assembly.
6 This bill removes the requirement that personnel working in
7 a licensed or registered child care facility must receive a
8 preemployment physical examination evidencing good health prior
9 to beginning employment. Under current law, personnel working
10 in a licensed or registered child care facility must take an
11 examination within six months prior to beginning employment.
12 Such examinations must be performed by a licensed physician
13 or physician’s assistant, include communicable disease tests,
14 and be repeated every three years after initial employment.
15 Controlled medical conditions which would not affect the
16 performance of the employee in the capacity employed does not
17 prohibit employment.
