1 An Act prohibiting certain actions relating to abortifacient
2 drugs in the state, and providing penalties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 144.29A, subsection 1, paragraph k, Code
2 2023, is amended to read as follows:
3 k. The method used for an induced termination, including
4 whether mifepristone was used.
5 Sec. 2. NEW SECTION. 146E.1 Abortifacient drugs ——
6 prohibited in the state.
7 1. Notwithstanding any other provision of law to the
8 contrary, it is unlawful for any person to manufacture,
9 distribute, prescribe, dispense, sell, or transfer
10 mifepristone, mifegyne, or mifeprex, or any substantially
11 similar generic or non-generic abortifacient drug in the state.
12 2. A person who violates this section is guilty of a class
13 “C” felony.
14 3. This section shall not be construed to impose civil
15 or criminal liability on a woman upon whom an abortion is
16 performed or attempted in which an abortifacient drug otherwise
17 prohibited under this section is used.
18 4. This section shall not be construed to prohibit the sale,
19 use, prescription, or administration of any contraceptive agent
20 administered prior to conception or before a pregnancy can be
21 confirmed through conventional medical testing.
22 EXPLANATION
23 The inclusion of this explanation does not constitute agreement with
24 the explanation’s substance by the members of the general assembly.
25 This bill provides that notwithstanding any other provision
26 of law to the contrary, it is unlawful for any person to
27 manufacture, distribute, prescribe, dispense, sell, or transfer
28 generic or non-generic abortifacient drugs in the state. A
29 person who violates the bill is guilty of a class “C” felony.
30 A class “C” felony is punishable by confinement for no more
31 than 10 years and a fine of at least $1,370 but not more than
32 $13,660.
33 The bill shall not be construed to impose civil or criminal
34 liability on a woman upon whom an abortion is performed or
35 attempted in which an abortifacient drug otherwise prohibited

1 under the bill is used. Additionally, the bill shall not
2 be construed to prohibit the sale, use, prescription, or
3 administration of any contraceptive agent administered prior
4 to conception or before a pregnancy can be confirmed through
5 conventional medical testing.
6 The bill makes a conforming change in the Code to eliminate a
7 reference to an abortifacient drug prohibited under the bill.
