1 An Act relating to the timing of physical examinations for
2 licensed or registered child care facility personnel.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 237A.5, subsection 1, Code 2023, is
2 amended to read as follows:
3 1. All personnel in licensed or registered facilities
4 shall have good health as evidenced by a report following a
5 preemployment physical examination taken within six months
6 prior to beginning employment or within thirty days following
7 the beginning of employment. The examination shall include
8 communicable disease tests by a licensed physician as defined
9 in section 135C.1 or a licensed physician assistant as defined
10 in section 148C.1 and shall be repeated every three years after
11 initial employment. Controlled medical conditions which would
12 not affect the performance of the employee in the capacity
13 employed shall not prohibit employment.
14 EXPLANATION
15 The inclusion of this explanation does not constitute agreement with
16 the explanation’s substance by the members of the general assembly.
17 This bill provides that all personnel of a licensed
18 or registered child care facility shall take a physical
19 examination to evidence good health within 6 months prior to
20 beginning employment or within 30 days following the beginning
21 of employment.
