1 An Act relating to the reporting of false information regarding
2 suspected dependent adult abuse in facilities and programs,
3 and providing penalties.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 235E.2, subsection 9, Code 2023, is
2 amended to read as follows:
3 9. a. A person required by this section to report a
4 suspected case of dependent adult abuse pursuant to subsection
5 2 who knowingly and willfully fails to do so within twenty-four
6 hours commits a simple misdemeanor.
7 b. A person required by subsection 2 to report a suspected
8 case of dependent adult abuse who knowingly fails to do so or
9 who knowingly interferes with the making of such a report or
10 applies a requirement that results in such a failure is civilly
11 liable for the damages proximately caused by the failure.
12 c. A person who reports or causes to be reported false
13 information regarding a suspected case of dependent adult abuse
14 pursuant to subsection 2, knowing that the information is false
15 or that the abuse did not occur, commits a simple misdemeanor.
16 EXPLANATION
17 The inclusion of this explanation does not constitute agreement with
18 the explanation’s substance by the members of the general assembly.
19 This bill relates to the reporting of false information
20 regarding suspected dependent adult abuse in facilities and
21 programs.
22 The bill provides that a person who reports or causes to
23 be reported false information regarding a suspected case of
24 dependent adult abuse, knowing that the information is false
25 or that the abuse did not occur, commits a simple misdemeanor.
26 A simple misdemeanor is punishable by confinement for no more
27 than 30 days and a fine of at least $105 but not more than $855.
