1 An Act relating to parental and guardian consent and
2 information regarding the gender identity of students
3 enrolled in a school district or charter school.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 256E.7, subsection 2, Code 2023, is
2 amended by adding the following new paragraph:
3 NEW PARAGRAPH. 0j. Be subject to and comply with the
4 requirements of section 279.77 relating to prohibited actions
5 associated with the gender identity of students in the same
6 manner as a school district.
7 Sec. 2. NEW SECTION. 279.77 Gender identity —— parental or
8 guardian consent —— prohibitions.
9 Each school district is prohibited from doing any of the
10 following:
11 1. Facilitating any accommodation that is intended to
12 affirm a student’s gender identity, if that gender identity
13 is different than the sex listed on the student’s official
14 birth certificate or certificate issued upon adoption if the
15 certificate was issued at or near the time of the student’s
16 birth, without the written consent of the student’s parent or
17 guardian. For purposes of this section, “gender identity” means
18 the same as defined in section 216.2.
19 2. Encouraging or coercing any student to withhold
20 information from the student’s parent or guardian related to
21 the student’s gender identity.
22 3. Willfully withholding information from, or knowingly
23 giving false or misleading information to, the parent or
24 guardian of a student regarding the student’s gender identity
25 or intention to transition to a gender that is different than
26 the sex listed on a student’s official birth certificate or
27 certificate issued upon adoption if the certificate was issued
28 at or near the time of the student’s birth.
29 4. Encouraging, pressuring, or coercing a student to
30 undergo any medical procedure, treatment, or intervention that
31 is designed to affirm the student’s gender identity if that
32 gender identity is different than the sex listed on a student’s
33 official birth certificate or certificate issued upon adoption
34 if the certificate was issued at or near the time of the
35 student’s birth.

1 5. Encouraging, pressuring, or coercing a student’s
2 parent or guardian to allow the student to undergo any medical
3 procedure, treatment, or intervention that is designed to
4 affirm the student’s gender identity if that gender identity
5 is different than the sex listed on the student’s official
6 birth certificate or certificate issued upon adoption if the
7 certificate was issued at or near the time of the student’s
8 birth.
9 EXPLANATION
10 The inclusion of this explanation does not constitute agreement with
11 the explanation’s substance by the members of the general assembly.
12 This bill relates to parental and guardian consent and
13 information regarding the gender identity of students enrolled
14 in a school district or charter school.
15 The bill prohibits school districts and charter schools
16 from facilitating any accommodation that is intended to
17 affirm a student’s gender identity, if that gender identity
18 is different than the sex listed on the student’s official
19 birth certificate, without the written consent of the student’s
20 parent or guardian; encouraging or coercing any student to
21 withhold information from the student’s parent or guardian
22 related to the student’s gender identity; willfully withholding
23 information from, or knowingly giving false or misleading
24 information to, the parent or guardian of a student regarding
25 the student’s gender identity or intention to transition to a
26 gender that is different than the sex listed on a student’s
27 official birth certificate; encouraging, pressuring, or
28 coercing a student to undergo any medical procedure, treatment,
29 or intervention that is designed to affirm the student’s
30 gender identity if that gender identity is different than
31 the sex listed on a student’s official birth certificate;
32 or encouraging, pressuring, or coercing a student’s parent
33 or guardian to allow the student to undergo any medical
34 procedure, treatment, or intervention that is designed to
35 affirm the student’s gender identity if that gender identity is

1 different than the sex listed on the student’s official birth
2 certificate.
3 The bill defines “gender identity” as a gender-related
4 identity of a person, regardless of the person’s assigned sex
5 at birth.
