1 An Act relating to the regulation of storm water by a county or
2    city.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

 1      Section 1. Section 331.301, Code 2023, is amended by adding
 2   the following new subsection:
 3      NEW SUBSECTION. 22. A county shall not adopt, enforce,
 4   or otherwise administer an ordinance, motion, resolution,
 5   or amendment providing for any terms or conditions of storm
 6   water regulation that exceed or conflict with federal or
 7   state statutes or regulations relating to storm water runoff,
 8   discharge, retention, or management.
 9      Sec. 2. Section 364.3, Code 2023, is amended by adding the
10   following new subsection:
11      NEW SUBSECTION. 18. A city shall not adopt, enforce,
12   or otherwise administer an ordinance, motion, resolution,
13   or amendment providing for any terms or conditions of storm
14   water regulation that exceed or conflict with federal or
15   state statutes or regulations relating to storm water runoff,
16   discharge, retention, or management.
17                             EXPLANATION
18           The inclusion of this explanation does not constitute agreement with
19            the explanation’s substance by the members of the general assembly.
20      This bill prohibits a county or city from adopting,
21   enforcing, or otherwise administering an ordinance, motion,
22   resolution, or amendment providing for any terms or conditions
23   of storm water regulation that exceed or conflict with federal
24   or state statutes or regulations relating to storm water
25   runoff, discharge, retention, or management.
