1 An Act providing for membership in a protection occupation
2 under the Iowa public employees’ retirement system and
3 including effective date and retroactive applicability
4 provisions.

1 Section 1. Section 97B.49B, subsection 1, paragraph e,
2 subparagraph (2), Code 2022, is amended to read as follows:
3 (2) A marshal in a city not covered under chapter 400 or a
4 fire fighter or police officer of a city covered employer not
5 participating in the retirement systems established in chapter
6 410 or 411.
7 Sec. 2. SERVICE RECLASSIFICATION. Notwithstanding any
8 provision of law to the contrary, a member of the Iowa public
9 employees’ retirement system whose prior regular service
10 position is reclassified by this Act as a protective occupation
11 service position shall have service by such member prior to the
12 effective date of this Act coded as service in a protection
13 occupation by the Iowa public employees’ retirement system
14 if certified by the employer of the member as constituting
15 protection occupation service under this Act. Membership
16 service shall be reclassified as provided by this Act without
17 any requirement to pay additional contributions for the payment
18 of the related actuarial costs of such reclassified service.
19 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate
20 importance, takes effect upon enactment.
21 Sec. 4. RETROACTIVE APPLICABILITY. This Act applies
22 retroactively to membership service under the Iowa public
23 employees’ retirement system on or after July 1, 2017.
24 EXPLANATION
25 The inclusion of this explanation does not constitute agreement with
26 the explanation’s substance by the members of the general assembly.
27 This bill provides that persons employed as a peace officer
28 or fire fighter by a covered employer, and not just a city,
29 under the Iowa public employees’ retirement system (IPERS)
30 are included within the protection occupation category
31 of IPERS. The bill provides that membership service prior
32 to the effective date of the bill shall be reclassified
33 as protection occupation service without payment of any
34 additional contributions to pay the actuarial costs of the
35 reclassified service if the employer certifies the employment

1 as constituting protection occupation service under the bill.
2 The bill takes effect upon enactment and applies to
3 membership service under IPERS on or after July 1, 2017.
