1 An Act relating to title fees for snowmobiles, all-terrain
2 vehicles, and vessels of surviving spouses.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 321G.31, subsection 1, Code 2021, is
2 amended to read as follows:
3 1. If ownership of a snowmobile is transferred by
4 operation of law, such as by inheritance, order in bankruptcy,
5 insolvency, replevin, or execution sale, the transferee, within
6 thirty days after acquiring the right to possession of the
7 snowmobile, shall mail or deliver to the county recorder of
8 the transferee’s county of residence satisfactory proof of
9 ownership as the county recorder requires, together with an
10 application for a new certificate of title, and the required
11 fee. However, if the transferee is the surviving spouse of the
12 deceased owner, the county recorder shall waive the required
13 fee.
14 Sec. 2. Section 321I.33, subsection 1, Code 2021, is amended
15 to read as follows:
16 1. If ownership of an all-terrain vehicle is transferred by
17 operation of law, such as by inheritance, order in bankruptcy,
18 insolvency, replevin, or execution sale, the transferee,
19 within thirty days after acquiring the right to possession of
20 the all-terrain vehicle, shall mail or deliver to the county
21 recorder of the transferee’s county of residence satisfactory
22 proof of ownership as the county recorder requires, together
23 with an application for a new certificate of title, and the
24 required fee. However, if the transferee is the surviving
25 spouse of the deceased owner, the county recorder shall waive
26 the required fee.
27 Sec. 3. Section 462A.82, subsection 1, Code 2021, is amended
28 to read as follows:
29 1. If ownership of a vessel is transferred by operation of
30 law, such as by inheritance, order in bankruptcy, insolvency,
31 replevin, execution sale, or in compliance with section 578A.7,
32 the transferee, within thirty days after acquiring the right
33 to possession of the vessel by operation of law, shall mail or
34 deliver to the county recorder satisfactory proof of ownership
35 as the county recorder requires, together with an application

1 for a new certificate of title, and the required fee. A title
2 tax is not required on these transactions. However, if the
3 transferee is the surviving spouse of the deceased owner, the
4 county recorder shall waive the required fee.
5 EXPLANATION
6 The inclusion of this explanation does not constitute agreement with
7 the explanation’s substance by the members of the general assembly.
8 Under current law, when ownership of a snowmobile,
9 all-terrain vehicle (ATV), or vessel is transferred by
10 operation of law, such as by inheritance, order in bankruptcy,
11 insolvency, replevin, or execution sale, the transferee
12 must pay a required certificate of title fee as part of the
13 application process to transfer ownership. The fee is paid to
14 the county recorder.
15 This bill requires that if the transferee is the surviving
16 spouse of the deceased owner, the county recorder must waive
17 the required fee.
18 The title fee for snowmobiles and ATVs is $10 and the title
19 fee for vessels is $5.
