3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 234.12A, Code 2021, is amended by adding
2 the following new subsections:
3 NEW SUBSECTION. 2A. A person who possesses three or more
4 electronic benefit transfer cards for which the person is
5 not authorized to possess is guilty of a fraudulent practice
6 pursuant to section 234.13, subsection 4.
7 NEW SUBSECTION. 2B. A law enforcement officer who has
8 probable cause to believe that a person possesses an electronic
9 benefits transfer card that the person is not authorized
10 to possess shall report the name on the electronic benefit
11 transfer card and the name of the person in possession of
12 the electronic benefits transfer card to the department of
13 inspections and appeals.
14 EXPLANATION
15 The inclusion of this explanation does not constitute agreement with
16 the explanation’s substance by the members of the general assembly.
17 This bill relates to electronic benefits transfer (EBT)
18 cards under the food assistance program and makes penalties
19 applicable.
20 The bill provides that a person who possesses three or more
21 EBT cards for which the person is not authorized to possess
22 is guilty of a fraudulent practice pursuant to Code section
23 234.13(4) (fraudulent practices relating to food programs).
24 The bill provides that a law enforcement officer who has
25 probable cause to believe that a person possesses an EBT card
26 that the person is not authorized to possess shall report the
27 name on the EBT card and the name of the person in possession of
28 the card to the department of inspections and appeals.
