Sir:
Your Cominittee on Government Operations, to which was
referred S.R. No. 156 entitled:
"SENATE RESOLUTION URGING ALL BOARDS AND COMMISSIONS TO
CONDUCT ANNUAL PERFORMANCE REVIEWS OF EXECUTIVE DIRECTORS OR
PERSONS HOLDING EQUIVALENT EXEMPT POSITIONS,"
begs leave to report as follows:
The purpose and intent of this measure is to urge all boards
and commissions to conduct annual performance reviews of their
Executive Directors or persons holding equivalent positions exempt
from civil service law.
Your Committee received testimony in support of this measure
from one individual.
Your Committee finds that the State has established various
boards and commissions to address specific community issues and
act as state liaisons for local communities. The day-to-day
operations of these entities and the execution of their directives
are often handled by Executive Directors or persons holding
equivalent positions. Your Committee further finds that although
these individuals play critical roles in resolving or improving
identified challenges or issues under the purview of their boards
and commissions, they are not subject to civil service law that
incorporates a merit-based system in the selection, management,
and discipline of employees. It is therefore critical that

oversight measures be implemented to ensure accountability and
integrity in the conduct of these employees. Accordingly, this
measure urges all boards and commissions to conduct annual
performance reviews of their Executive Directors or persons
holding equivalent positions exempt from civil service law.
Your Committee has amended this measure by:
(1) TXmending its title to better reflect its purpose; and
(2) Making technical, nonsubstantive amendments for the
purposes of clarity and consistency.
As affirmed by the record of votes of the members of your
Committee on Government Operations that is attached to this
report, your Committee concurs with the intent and purpose of S.R.
No. 156, as amended herein, and recommends its adoption in the
form attached hereto as S.R. No. 156, S.D. 1.
