This bill amends sections 501.9984, 501.9985, and 501.9986 of the Florida Statutes to create exemptions from public records requirements for information held by the Department of Legal Affairs concerning notifications or investigations of violations related to companion chatbots, bots, and deidentified data. It establishes that all information related to these investigations is confidential and exempt from public disclosure until the investigation is completed or ceases to be active. The bill also permits limited disclosures during active investigations for specific purposes, such as aiding in victim identification or fulfilling official duties. Upon the conclusion of an investigation, sensitive information, including personal identifying information and proprietary data, will remain confidential.
Furthermore, the bill defines "proprietary information" and includes a statement of public necessity, highlighting the importance of maintaining confidentiality to protect individuals and businesses from potential harm, such as identity theft and competitive disadvantages. The exemptions are subject to future legislative review and will be repealed on October 2, 2031, unless reenacted. The legislation aims to strike a balance between the need for transparency and the necessity of protecting sensitive information during investigations, ensuring that the effective administration of these investigations is not compromised. The act is set to take effect concurrently with related legislation, SB 482, if passed.
