The proposed bill, titled the "Motor Vehicle Data Privacy and Autonomy Act," aims to enhance the privacy and control of motor vehicle owners over their operator data. It establishes new regulations under section 320.647 of the Florida Statutes, defining key terms such as "operator data," "personal identifying information," and "secure." The bill prohibits manufacturers from accessing operator data without the owner's consent, selling or sharing such data without specific conditions, and disclosing personal identifying information to foreign entities. Additionally, it mandates that manufacturers provide vehicle owners with access to and control over their operator data through a secure and technologically neutral interface, at no extra cost.
The bill also outlines reporting requirements for the Department of Highway Safety and Motor Vehicles, which must submit annual reports detailing the types of operator data accessed, entities involved, and cybersecurity risks associated with motor vehicles. By January 1, 2028, the department is tasked with establishing at least one standard for the required interface, with subsequent reviews every five years. Violations of these provisions are classified as unfair and deceptive trade practices, and the department is authorized to adopt rules for enforcement. The act is set to take effect on July 1, 2026.
