The bill amends section 768.0706 of the Florida Statutes to establish conditions under which owners and principal operators of multifamily residential properties may not receive a presumption against liability. Specifically, it introduces a new subsection (4) that stipulates that if two or more specified crimes—such as murder, robbery, sexual battery, aggravated assault, battery, kidnapping or false imprisonment, or any crime involving a firearm—are reported to have occurred at the property within the 24 months preceding a related incident, the owner or principal operator will not benefit from the presumption of liability protection.
This legislative change aims to enhance accountability for property owners and operators in relation to crime on their premises, thereby potentially increasing safety and security for residents. The bill is set to take effect on July 1, 2026.
