This bill amends Florida Statutes to establish the offense of aggravated stalking, defined as willfully, maliciously, and repeatedly following, harassing, or cyberstalking another person while committing specific acts such as entering the victim's property without consent, committing lewd acts, or transmitting unsolicited sexually explicit material. Aggravated stalking is classified as a third-degree felony, with penalties outlined in sections 775.082, 775.083, or 775.084. The bill also includes amendments to sections 921.0022 and 948.06 to conform cross-references related to aggravated stalking.
Additionally, the bill redesignates existing subsections in section 784.048 and introduces a new subsection (6) that details the criteria for aggravated stalking. It also updates the offense severity ranking chart to reflect the new classification of aggravated stalking and modifies the definition of qualifying offenses in relation to probation violations. The effective date for this act is set for October 1, 2026.
