The bill mandates that Medicaid managed care plans reimburse licensed home health agencies for private duty nursing services at a rate no less than the established Private Duty Nursing Fee Schedule, regardless of the number of Medicaid-eligible individuals sharing a dwelling. Additionally, it prohibits reductions in reimbursement based on the number of recipients receiving services simultaneously in the same location.
Furthermore, the bill requires Medicaid managed care plans to negotiate service rates with affiliated businesses at least annually and to provide written certification upon request, ensuring that reimbursement rates for services in these integrated communities are not lower than those for similar services in private residences within the same Medicaid region. The Agency for Health Care Administration is tasked with seeking federal approval for these changes within 30 days of the bill's effective date, and the implementation of the act is contingent upon receiving that approval.
