The bill establishes a new section, 323.003, in the Florida Statutes concerning the towing of disabled vehicles. It mandates that when a vehicle is disabled due to a crash and requires towing, law enforcement officers must provide the driver with a list of wrecker operators to choose from if the vehicle is being impounded. Alternatively, the driver has the option to call a wrecker operator of their choice. Additionally, both the law enforcement officer and the wrecker operator are required to inform the driver about the daily storage charges, the contact information for the wrecker operator's storage facility, and the process for retrieving the vehicle.
Furthermore, the bill requires wrecker operator storage facilities to notify the vehicle owner in writing via certified mail, as well as by telephone and text message, at specified intervals (14, 30, and 45 business days) after the vehicle has been stored. This notification must inform the owner that their vehicle is in storage and accruing daily charges. The act is set to take effect on July 1, 2026.
