This bill creates a new legal framework in Florida to address marriage fraud by establishing Section 908.14 of the Florida Statutes. It defines marriage fraud as knowingly entering into a marriage to evade immigration laws and engage in acts of violence, manipulation, abuse, coercion, or financial harm, particularly when the perpetrator is not a U.S. citizen. Victims of marriage fraud are empowered to file a verified petition for an injunction for protection without the need for an attorney, and the court is prohibited from requiring a bond for these injunctions. The bill mandates that clerks of the court provide necessary forms and assistance without charging a filing fee.

Additionally, the bill outlines the process for obtaining injunctions, including requirements for petitions, hearings, and document service. It allows for temporary injunctions in cases of immediate danger and specifies enforcement conditions. The legislation establishes a "Board of Immigration Enforcement" to coordinate with law enforcement and federal agencies, mandates the electronic transmission of proof of service of injunctions within 24 hours, and requires the Florida Association of Court Clerks and Comptrollers to develop an automated notification process for petitioners. Penalties for violations of injunctions are classified as misdemeanors of the first degree, with provisions for swift court action in cases of immediate danger and consequences for repeat offenders. The act is set to take effect on October 1, 2026.
