This bill amends section 581.217 of the Florida Statutes to impose stricter regulations on the manufacture, sale, and distribution of hemp and hemp extract products. Businesses selling hemp products are required to avoid items that may attract children, maintain a minimum distance from schools and daycare facilities, and follow strict advertising guidelines that necessitate preapproval from the Department of Agriculture and Consumer Services. The bill also establishes requirements for record-keeping, product storage, and compliance with health and safety regulations, while banning the sale of hemp products intended for smoking and outlining penalties for violations.
In addition, the bill addresses contraband regulations in state correctional institutions and detention facilities by clarifying what constitutes contraband, including written communications, food, intoxicating beverages, controlled substances, firearms, and portable communication devices. It defines "portable communication device" and "vapor-generating electronic device," prohibiting their unauthorized introduction into secure areas. Furthermore, the bill allocates $2 million in nonrecurring funds from the General Revenue Fund to the Department of Law Enforcement for purchasing necessary testing equipment, with the act set to take effect on July 1, 2026.
