The bill mandates that students' voluntary expressions of these viewpoints in coursework, artwork, and other assignments be treated equally to other viewpoints, and it allows students to wear clothing and accessories that display political or ideological messages. Additionally, students are authorized to engage in or organize political or ideological activities and groups, with equal access to school facilities for such groups.
Furthermore, the bill establishes a private cause of action for individuals or student groups harmed by violations of these provisions, allowing them to seek declaratory and injunctive relief, statutory damages, and attorney fees. It also waives state immunity for violations of this section, permitting lawsuits in federal court. The Department of Education is tasked with developing a model policy regarding a limited public forum for student expression, which school districts must adopt. The act is set to take effect on July 1, 2026.
