This bill establishes new requirements for the expansion of the Monarch Hill Landfill in Broward County, Florida. It defines the Monarch Hill Landfill as the solid waste disposal facility currently operating under permits from the Department of Environmental Protection. Before any expansion can occur, the bill mandates that a feasibility study be conducted by an independent third-party entity with expertise in environmental engineering, solid waste management, and public health impacts. The study must assess environmental and public health impacts, analyze alternative waste management solutions, evaluate potential impacts to surrounding communities, and consider the cumulative effects of existing operations and the proposed expansion.
Additionally, the bill requires at least one public hearing to be held within a 5-mile radius of the landfill prior to the final approval of any expansion. This hearing must be publicly noticed 30 days in advance, allow for meaningful public input, and include a presentation of the feasibility study's findings. Approval for any application, zoning change, permit, or development order related to the landfill's expansion cannot proceed until the feasibility study and public hearing requirements have been fulfilled and disclosed. The act is set to take effect on October 1, 2026.
