This bill amends section 725.08 of the Florida Statutes to modify the terms under which professional services contracts can be established between design professionals and contracting parties. It allows these contracts to require design professionals to indemnify and hold harmless the contracting party and its employees only for specific liabilities caused by the design professional's negligence or wrongful conduct. Additionally, the bill stipulates that all professional services contracts cannot require design professionals to defend or indemnify the contracting party or its employees, declaring such provisions void as against public policy.
Furthermore, the bill introduces new requirements for professional services contracts, mandating that design professionals perform their services with a standard of care that reflects the level of skill and care typically provided by competent professionals in similar circumstances. It also prohibits contracts from imposing a different standard of care and from requiring design professionals to list contracting parties as additional insureds on their liability insurance policies. The changes will take effect on July 1, 2026, and will not affect contracts entered into before that date.
