The bill amends Florida Statutes to regulate auxiliary containers, which are defined as reusable or single-use bags, cups, bottles, cans, or other packaging designed for transporting, consuming, or protecting merchandise, food, or beverages. The legislation preempts local governments from enacting or enforcing regulations regarding the use, disposition, sale, prohibition, restriction, or tax of auxiliary containers unless authorized by general law. However, it allows local governments to restrict the use of glass auxiliary containers within public beaches or state parks and authorizes the Division of Recreation and Parks to regulate auxiliary containers in state parks.

Additionally, the bill removes obsolete provisions that required the Department of Environmental Protection to review and update a report on retail bags and their regulation. It also updates cross-references within the statutes to ensure consistency. The effective date for this act is set for July 1, 2026.
