This bill amends section 627.748 of the Florida Statutes to revise the automobile insurance requirements for transportation network companies (TNCs), TNC drivers, and vehicle owners. Key changes include the establishment of specific insurance coverage requirements for TNC drivers while they are logged onto the TNC's digital network or engaged in a prearranged ride. The bill introduces a new paragraph that mandates primary automobile liability coverage of at least $50,000 for death and bodily injury per person, $100,000 per incident, and $25,000 for property damage when a TNC driver has accepted a prearranged ride but no rider is in the vehicle. Additionally, it requires personal injury protection benefits and uninsured/underinsured vehicle coverage.
The bill also specifies that while a TNC driver is engaged in a prearranged ride with a rider in the vehicle, the required automobile insurance must provide at least $1 million in primary liability coverage. The TNC is responsible for maintaining the required coverage unless the driver has a policy that meets the necessary coverage requirements. Furthermore, TNC drivers are required to carry proof of their insurance coverage at all times and must provide this information in the event of an accident. The act is set to take effect on July 1, 2026.
