The bill amends the Family Empowerment Scholarship Program by introducing new requirements for private schools participating in the program. Specifically, it mandates that private schools provide certain information in writing to parents before a student's initial enrollment. This information includes details about the school's academic programs, policies, code of conduct, attendance policies, and specialized services and therapies offered. Additionally, schools are allowed to update the information regarding specialized services and therapies once per school year or when the school district updates its list of equitable services, whichever occurs first.
Furthermore, the bill stipulates that within 30 days after a school district provides a student with a private school services plan, parents of students with individualized education plans, English language learner plans, or 504 plans must be informed about the modifications, accommodations, and therapies that will be honored as part of the student's plan. If a private school fails to comply with these requirements, the commissioner has the authority to determine the school's ineligibility to participate in the scholarship program. The act is set to take effect on July 1, 2026.
