The bill amends section 381.00321 of the Florida Statutes to enhance the enforcement of the right of medical conscience for health care providers and payors. It allows these entities to file a complaint with the Attorney General if they believe their rights have been violated. If the Attorney General finds a violation, they can initiate a civil action for damages or other appropriate relief. The bill also grants the Attorney General the authority to conduct investigations, including administering oaths and issuing subpoenas.
Importantly, the bill introduces a provision that permits health care providers and payors to commence their own civil actions if the Attorney General does not act within 180 days of the complaint being filed. This includes the ability to seek damages, injunctive relief, or to use the alleged violation as a defense in judicial or administrative proceedings. The effective date for this act is set for July 1, 2026.
