This bill amends several sections of Florida Statutes related to condominium associations, primarily focusing on the management and accessibility of turnover certificates and annual reports. It requires condominium associations to maintain turnover certificates and annual reports as part of their official records. Specifically, the board of administration must file a turnover certificate with the Division of Condominiums, Timeshares, and Mobile Homes within 30 days after a majority of the board is elected by unit owners. The turnover certificate must include the election date and the names and addresses of the elected board members. Additionally, the division is mandated to create and maintain a publicly accessible online database of these turnover certificates.
The bill also introduces new provisions regarding the statute of limitations for actions by condominium associations, clarifying that such limitations do not begin until a majority of the board is elected. It specifies that this tolling does not apply to certain actions outlined in existing law. Furthermore, the division is tasked with adopting rules for the turnover certificate's form and content, as well as the procedures for electronic filing. The effective date for this act is set for July 1, 2026.
