The bill establishes new provisions regarding leave for living organ donation in Florida. It creates Section 110.1185 of the Florida Statutes, which mandates that state agencies grant administrative leave, with pay, for up to 30 working days to employees who serve as living organ donors. This leave is in addition to any other leave types authorized by law. The bill also defines "living organ donor" as an individual who donates all or part of a human organ while alive for transplantation.
Additionally, the bill introduces Section 381.865, which applies to private employers and local governments. It requires these employers to provide unpaid leave of absence for employees who wish to serve as living organ donors, contingent upon a written request from the employee. The length of this unpaid leave must not exceed 30 working days or the time requested by the employee, whichever is shorter. Employers are permitted to offer paid or unpaid leave beyond the mandated period. The act is set to take effect on July 1, 2026.
