The bill introduces a new section, 487.082, to the Florida Pesticide Law, which establishes that a products liability action based on failure to warn cannot be initiated for any pesticide registered with the United States Environmental Protection Agency (EPA) under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), provided that the pesticide's label meets certain criteria. These criteria include that the label must be approved by the EPA, align with the latest human health risk assessment conducted under FIFRA, and be consistent with the EPA's classification of the pesticide's carcinogenicity.

However, the bill includes an important exception: manufacturers will not be protected from liability if the EPA finds that they knowingly withheld, concealed, misrepresented, or destroyed material information regarding the health risks or carcinogenicity of the pesticide to secure or maintain the label's approval. The act is set to take effect on July 1, 2026.
