The proposed bill establishes a new section, 487.082, in the Florida Pesticide Law, which addresses products liability actions related to pesticides. It prohibits such actions based on a manufacturer's failure to warn if the pesticide's label meets specific criteria, including being approved by the United States Environmental Protection Agency (EPA), aligning with the latest human health risk assessments under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and conforming to the EPA's carcinogenicity classification.

However, the bill includes an exception that maintains liability for manufacturers if the EPA determines that they knowingly withheld, concealed, misrepresented, or destroyed material information regarding the health risks or carcinogenicity of a pesticide to secure or maintain label approval. The act is set to take effect on July 1, 2026.
